Big Changes Coming for Ontario New Homebuyers on January 1, 2026: What You Need to Know

Beginning January 1, 2026, Tarion, the organization that administers Ontario’s new home warranty program, will introduce an important new step for all buyers of new freehold homes.

This change strengthens consumer protection and targets illegal homebuilding and selling practices across the province.

As trusted real estate advisors, we must understand how this affects our clients so they stay fully protected when purchasing a new-construction home.

What’s Changing?

Starting Jan. 1, 2026:

New freehold homebuyers will be encouraged to register their purchase agreement with Tarion within 45 days of signing.

Doing so ensures they receive the maximum available deposit protection coverage.

If a buyer fails to register within the 45-day window—or doesn’t register at all—they may receive reduced coverage.

Why this matters

Illegal homebuilding and selling have become a serious problem in Ontario. This new step helps Tarion confirm quickly whether:

  • The builder is legally licensed to sell

  • The construction is authorized

  • Any suspicious activity needs immediate action through the Home Construction Regulatory Authority (HCRA)

Tarion’s CEO, Peter Balasubramanian, explains:

“Illegal home building and selling is a serious problem that hurts consumers… By adding this new step, we’ll be able to confirm that the builder was approved to sell and if not, act quickly to shut down illegal activity.”

How Buyers Will Register

Tarion is launching an easy-to-use online portal where freehold buyers can:

  • Register their purchase

  • Confirm deposit coverage

  • Access important warranty details from Tarion

Once registered, buyers will receive all warranty information directly, ensuring they understand exactly what’s covered for the first seven years after possession.


Important: No Change for New Condo Purchases

This new registration step does NOT apply to condominium buyers.
Tarion’s deposit structure for condo projects is already handled differently, and condo purchasers are not required to notify Tarion.

Warranty coverage for all new homes, freehold or condo, remains the same:
7 years of coverage for defects outlined under the builder’s warranty.
